Terms of Service

These Terms of Service ("Terms") govern your use of the InkCapture mobile application ("App") operated by Sovereign Action LLC ("we," "our," or "us"). By downloading or using InkCapture, you agree to these Terms.

1. Acceptance of Terms

By accessing or using InkCapture, you confirm that you are at least 13 years old and agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Service

InkCapture is a document scanning, OCR text extraction, and fax transmission application for iOS devices. The App provides:

• Document scanning with auto-edge detection and image enhancement
• On-device optical character recognition (OCR)
• Document organization with folders and tags
• Digital signature placement
• Export to PDF, JPEG, and PNG formats
• Fax transmission services (paid feature)

3. User Accounts

InkCapture does not require account creation. The App identifies your device using Apple's vendor identifier solely for managing fax usage limits and subscription entitlements.

4. Free and Paid Features

4.1 Free Tier

The free tier includes unlimited document scanning, OCR, editing, folders, tags, and exporting. Free exports include a subtle InkCapture watermark.

4.2 Pro Subscription

The Pro subscription removes watermarks and includes fax pages. Subscription details:

• Subscriptions are billed monthly or annually through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

4.3 Fax Day Pass

The Fax Day Pass is a one-time purchase providing 10 fax pages within a 24-hour window. Day Pass purchases are non-refundable.

5. Fax Service Terms

• Delivery: We make reasonable efforts to deliver faxes promptly. Typical delivery time is approximately 60 seconds. However, we cannot guarantee delivery times or successful delivery, as fax transmission depends on the recipient's fax machine and phone line.
• Content: You are solely responsible for the content you fax. You must not use the fax service to transmit illegal, fraudulent, harassing, or otherwise prohibited content.
• Usage limits: Fax pages are subject to monthly limits based on your subscription tier. Unused pages do not roll over to the next billing period.
• Accuracy: You are responsible for verifying the recipient's fax number. We are not liable for faxes sent to incorrect numbers.

6. Acceptable Use

You agree not to:

• Use InkCapture for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use the fax service to send unsolicited bulk faxes (spam)
• Interfere with or disrupt the App's servers or infrastructure
• Circumvent usage limits or subscription restrictions
• Use the App to infringe on intellectual property rights of others

7. Intellectual Property

InkCapture and all associated branding, design, and code are the property of Sovereign Action LLC. You retain full ownership of all documents you scan, create, or transmit using the App.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we handle your information. Key point: all document processing happens on your device — we never see or store your documents.

9. Disclaimers

• InkCapture is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee that the App will be error-free, uninterrupted, or compatible with all devices.
• OCR accuracy depends on document quality and is provided as a convenience, not as a certified transcription service.
• Fax delivery depends on third-party telecommunications infrastructure beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, Sovereign Action LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of InkCapture, including but not limited to lost data, failed fax deliveries, or business losses. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to InkCapture if you violate these Terms. You may stop using the App at any time by uninstalling it. Termination does not affect your obligation to pay for services already rendered.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by updating the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the appropriate courts of the jurisdiction in which Sovereign Action LLC is registered.
